Terms of Use & End User License Agreement

1. Introduction

These Terms of Use and End User License Agreement ("Agreement") form a legally binding contract between MagicTrunk ("MagicTrunk," "we," "our," or "us") and you ("you," "your," or "user") regarding your access to and use of our mobile applications, websites, and related services (collectively, the "App" or "Apps").

The name of an App may differ depending on the country or platform and may change without prior notice.

By downloading, installing, accessing, or using any of our Apps, you confirm that you have carefully read, understood, and agreed to be bound by this Agreement and all documents referenced within it.

If you do not agree with these Terms, you must not download, install, access, or use the Apps. If already installed, you should immediately discontinue use and remove the Apps from your device.

2. Changes to These Terms

We may revise or update this Agreement from time to time whenever necessary. The latest version will always be available within the App or on our website.

Your continued use of the App after any changes become effective constitutes your acceptance of the updated Agreement. We encourage you to review these Terms periodically.

3. Eligibility

Our Apps are intended for users who are legally permitted to enter into this Agreement.

If you are under the age of 18 in your jurisdiction, you may use the Apps only with the supervision and permission of your parent or legal guardian.

Children under the age of 13 are not permitted to create accounts or use features requiring personal information unless allowed under applicable law and supervised by a parent or guardian.

Parents and guardians are responsible for monitoring and supervising a child's use of the Apps and ensuring appropriate usage.

By using the Apps, you represent that:

  • you are at least 18 years old; or

  • you have obtained permission from your parent or legal guardian; and

  • you are legally capable of entering into this Agreement.

4. General Information

MagicTrunk develops entertainment and educational mobile applications for users of various ages.

Features available within an App may differ depending on the platform, region, device compatibility, and future updates.

5. Privacy

Your privacy is important to us.

Our collection, use, and protection of personal information are described in our Privacy Policy, which forms part of this Agreement.

By using the Apps, you acknowledge that you have reviewed and accepted our Privacy Policy.

If you disagree with the Privacy Policy, you must discontinue using the Apps immediately.

6. License Grant & Intellectual Property

Subject to your compliance with this Agreement, MagicTrunk grants you a limited, personal, non-exclusive, non-transferable, revocable, and non-sublicensable license to install and use the Apps solely for your personal, non-commercial use.

All ownership rights, including copyrights, trademarks, software, graphics, artwork, sounds, animations, videos, interfaces, source code, and other intellectual property contained within the Apps remain the exclusive property of MagicTrunk or its licensors.

Nothing contained in this Agreement transfers ownership of any intellectual property to you.

Unless expressly permitted by law or by MagicTrunk in writing, you may not:

  • copy or reproduce the Apps;

  • modify or create derivative works;

  • distribute or sell any portion of the Apps;

  • reverse engineer, decompile, or disassemble the software;

  • remove copyright notices or trademarks; or

  • use our intellectual property for commercial purposes.

All rights not expressly granted remain reserved.

7. User Content

Some Apps may allow you to upload, create, generate, or share content ("User Content").

You retain ownership of any original content you create or upload, provided you have the legal rights to do so.

By submitting User Content through the App, you confirm that:

  • you own the necessary rights or have permission to use the content;

  • your content does not violate any law;

  • your content does not infringe another person's intellectual property or privacy rights.

You are solely responsible for the content you submit and any consequences arising from its use or distribution.

8. Prohibited Use

You agree not to use the Apps to:

  • violate any applicable law or regulation;

  • infringe copyrights, trademarks, or other intellectual property rights;

  • harass, threaten, abuse, or intimidate others;

  • upload harmful software, malware, or viruses;

  • distribute misleading or fraudulent content;

  • promote violence, hatred, discrimination, or illegal activity;

  • upload obscene, pornographic, or sexually explicit material;

  • encourage self-harm or dangerous behavior;

  • interfere with the operation or security of the Apps.

You also agree not to:

  • copy or redistribute any part of the Apps without permission;

  • rent, lease, sublicense, or commercially exploit the Apps;

  • attempt to bypass security measures;

  • use automated systems to access the Apps without authorization.

MagicTrunk reserves the right to suspend or terminate access for violations of this Agreement.

9. Availability

We strive to keep our Apps available and functioning properly; however, we do not guarantee uninterrupted or error-free operation.

We may update, modify, suspend, or discontinue any feature of the Apps at any time without prior notice.

You are responsible for maintaining compatible devices and internet access necessary to use the Apps.

10. Purchases & Subscriptions

Certain Apps may include optional premium features available through one-time purchases or automatically renewing subscriptions.

Pricing is displayed within the App or on the applicable app store before purchase.

Subscriptions automatically renew unless cancelled at least 24 hours before the current billing period ends.

Payment is charged through your Apple App Store or Google Play account at confirmation of purchase.

You can manage or cancel subscriptions at any time through your Apple ID or Google Play account settings.

Deleting the App does not automatically cancel an active subscription.

We may modify subscription plans, pricing, or available features in accordance with applicable law.

11. Third-Party Services

Our Apps may include links to third-party websites, products, or services.

MagicTrunk does not control and is not responsible for the content, privacy practices, availability, or services provided by third parties.

Any interaction with third-party services is solely between you and the respective provider.

12. Disclaimer

The Apps are provided on an "AS IS" and "AS AVAILABLE" basis.

To the fullest extent permitted by law, MagicTrunk disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Apps will always be secure, uninterrupted, accurate, or free from errors or harmful components.

13. Limitation of Liability

To the maximum extent permitted by law, MagicTrunk and its affiliates, employees, licensors, and partners shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from your use of the Apps.

Our total liability shall not exceed the amount you paid for the App or related purchases during the twelve months preceding the claim, where permitted by law.

You agree to indemnify and hold MagicTrunk harmless from claims, losses, liabilities, damages, costs, and expenses resulting from your misuse of the Apps or your violation of this Agreement.

14. Third-Party Beneficiaries

If you download the Apps through Apple App Store, Google Play, Amazon Appstore, or another authorized marketplace, the respective platform provider and its affiliates are intended third-party beneficiaries of this Agreement and may enforce applicable provisions where permitted.

15. Termination

We reserve the right to suspend or terminate your access to the Apps immediately if you violate this Agreement or if continued access is no longer appropriate.

Upon termination, all rights granted under this Agreement immediately cease, and you must stop using the Apps.

16. Severability

If any provision of this Agreement is determined to be unlawful, invalid, or unenforceable, the remaining provisions shall remain in full force and effect.

Failure by MagicTrunk to enforce any provision shall not constitute a waiver of that provision.

You may not assign or transfer your rights under this Agreement without our written consent.
